Terms and Conditions
Please read the following booking conditions carefully as they explain the responsibilities and conditions for booking a tour and upon acceptance of the booking.
1. Confirm a Booking
Reservations should be made with a confirmation email which details the number of people on the tour as well as a primary contact name and address.
A non-refundable deposit of 10% of the total fee is required a minimum of 30 days before the tour date. Once this deposit has been paid a full itinerary will be forwarded to the primary contact.
The balance due can either be paid in advance or on the day of the tour.
3. Price Changes
The price displayed on the website is guaranteed to you in the event of a booking. Any changes will not be applied to existing bookings.
4. Cancelling Your Trip
The cancellation of the tour must be made by the primary contact responsible for making the booking.
Where possible we will endeavour to accommodate any reasonable request to change your booking. Where your travel arrangements depend on a certain number of people and your change involves a change to the number of people in your party the price for the entire booking will be recalculated on the basis of the new party size. Where we are not able, at our discretion, to help you in respect of your request to change your booking and you are not prepared to proceed with your travel arrangements as booked this will be treated as a cancellation and your deposit will not be refunded.
5. Trip Cancelled by Us
If due to unusual or unforeseeable circumstances beyond the control of Marbella Escapes we will notify the primary contact as soon as possible. If a deposit has been paid then the money will refunded in full.
6. Trip Cancelled by Marbella Escapes
All information is deemed to be correct at the time of writing. Any 3rd Party Changes (such as opening times, availability etc.) will be communicated to the primary contact; however Marbella Escapes accepts no responsibility for changes to the tour outside of our control. If you are not in agreement with the changes and a deposit has been paid, again this will be refunded in full.
7. Travel Insurance
Some of our tours involve walks in Mountainous areas or activities such as mountain biking or watersports. The temperatures in summer can be very high and we take every care to ensure we avoid the hottest part of the days and water is provided.
Any allergies (such as Bee sting) or illness which could be complicated by heat or strenuous exercise should be reported to Marbella Escapes and we will advise whether you should seek further medical advice.
We will advise on booking any specific requirements (such as safety helmets, walking boots etc.)
You must have comprehensive travel insurance and your acceptance of these terms and conditions signifies you have travel insurance in place.
8. Marbella Escapes Liability
We will make every conceivable effort to ensure that all our tours and services are provided to a reasonable standard and in accordance with the description advertised.
Marbella Escapes does not accept responsibility for any personal injury or death caused to you as a result of the proven negligent acts and/or omissions of our guides, agents, or sub-contractors. We shall not be liable for any damages caused by the total or partial failure to carry out the tour if such failure is:
- the faulty of any member of the tour party,
ii) the fault of a third party unconnected to Marbella Escapes
iii) a result of unusual or unforeseen circumstances beyond the control of the guide, the company or the 3rd party supplier of the trip in question which could not have been predicted or avoided by taking all reasonable care (“Force Majeure”)
Tour Members will be liable for any damage caused by themselves either to the property of Marbella Escapes or to 3rd party property.
9. Should you have a complaint
In the event of any problems arising during your tour, you should endeavor to resolve them directly with the tour guide. If the problem cannot be resolved at this time you should write to Marbella Escapes via email giving full details of your complaint. The complaint will be addressed according to our internal procedures.
10. Special requests
Any special requests for your tour will are noted, and we will do our very best to comply with these, we cannot guarantee however especially with 3rd party suppliers that they will be provided.
All tour members are expected to behave in a polite and courteous way with our guides, other members of the tour and 3rd party suppliers. We reserve the right to cancel your involvement in the tour should your behaviour be unacceptable or illegal. No refund will be given and we will have no responsibility to arrange travel or accommodation should you be asked to leave a tour.
12. Travel arrangements
Final timings and tour routes will be supplied upon payment of the 10% deposit.
13. Force majeure
This is the term applied to unusual and unforeseeable circumstances that are beyond our control. Compensation payments do not apply to changes, cancellations or curtailment caused by reason of war, threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disaster, fire, adverse weather conditions, floods etc, technical problems of transport, closure or congestion at airports or ports, cancellation or changes of schedule by airlines or similar events. We cannot accept responsibility where the performance or prompt performance of our contract with you is prevented or affected as a result of such circumstances.
14. Data Protection Act
In order to process your booking and ensure that your tour goes smoothly, we may need to use the information you provide such as name, address, any special needs/dietary requirements etc. This information may be passed on to the relevant supplier, especially in the case of tickets, course or restaurant bookings. The information may also be provided to public authorities if required by them or as required by law. We take full your privacy seriously and will never pass on your details to a 3rd party unless necessary by law or procedure.
Photographs taken on any of our tours may be used by Marbella Escapes without prior permission or payment in all media for promotional or marketing purposes.
16. Travel Resources and Ancillary Products
We do recommend hotels, restaurants and other services as part of our efforts to ensure you have a fantastic tour. We also sell and market books through Amazon.co.uk. Marbella Escapes will accept no responsibility for the service or actions of these 3rd party suppliers and any issues or complaints should be taken up with the relevant party directly.
